PUPPY RESERVATION TERMS & CONDITIONS

These Puppy Reservation Terms & Conditions apply to puppies and future puppy reservations made with Bullymon.

By paying a holding deposit, the buyer confirms that they have read, understood and accepted these terms.

Nothing in these terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under applicable Australian consumer law.

1. Puppy Applications

If you are interested in a puppy, please complete our PUPPY APPLICATION FORM.

Submitting an application does not guarantee approval or reserve a puppy.

Applications are reviewed by Bullymon to help us determine whether the proposed home is suitable for the individual puppy and placement.

Once an application has been reviewed and approved, we will contact the applicant with the relevant puppy information, pricing, payment instructions and next steps.

2. Reserving a Current Puppy

A $1,000 AUD holding deposit is required to reserve a specific puppy unless otherwise agreed in writing by Bullymon.

A puppy remains available for enquiry until the required holding deposit has been received and confirmed by Bullymon.

Once the deposit has been received, the puppy will be considered reserved for that buyer and may be marked Reserved or otherwise removed from general availability.

The $1,000 holding deposit forms part of the total purchase price of the puppy.

The holding deposit is non-refundable if the buyer changes their mind, decides not to proceed with the purchase, fails to make the remaining payment by the agreed due date, or otherwise withdraws from the reservation, subject to any rights the buyer may have under applicable law.

3. Future Puppy & Pick Reservations

Approved applicants may also reserve a future puppy or an agreed pick position from an upcoming Bullymon breeding.

A $1,000 AUD holding deposit is required to secure a future puppy reservation or pick position unless otherwise agreed in writing.

A future reservation or pick position does not guarantee that a breeding will result in pregnancy or that a particular sex, colour, size, structure, appearance or other characteristic will be produced.

Where a numbered pick position has been reserved, selection will take place in the agreed order from the puppies Bullymon makes available for placement.

Bullymon may retain puppies for its own breeding program before puppies are made available for external selection where this forms part of the applicable breeding or reservation arrangement.

Additional Deposit Following Puppy Selection

For future litter and pick reservations, the initial $1,000 AUD holding deposit secures the buyer’s reservation or agreed pick position.

Once the buyer’s puppy selection has been made, an additional deposit may be required to confirm and secure the selected puppy.

The amount of the additional deposit will vary depending on the individual puppy and will be disclosed to the buyer before the puppy selection is confirmed.

Any initial holding deposit and additional deposit paid will be credited toward the total purchase price of the selected puppy.

Once the buyer has selected their puppy and the additional deposit has been paid, all deposits relating to that puppy are non-refundable if the buyer subsequently changes their mind, withdraws from the purchase or fails to complete payment by the agreed due date, subject to applicable law.

If Bullymon is unable to complete the agreed placement of the selected puppy, any applicable refund or transfer will be handled in accordance with the Deposits, Refunds & Transfers section of these Terms & Conditions.

4. Deposits, Refunds & Transfers

Holding deposits are generally non-refundable where the buyer chooses not to proceed with their reservation.

However, if Bullymon is unable to provide the puppy or agreed pick covered by the reservation, the buyer may be offered the choice of a refund or transfer, depending on the circumstances and subject to applicable law.

This may include circumstances where:

• the planned breeding does not result in a pregnancy;
• the agreed pick position cannot be fulfilled, for example where there are insufficient puppies of the reserved sex;
• the specifically reserved puppy does not pass Bullymon’s veterinary health examination and Bullymon determines that the puppy should not proceed with the agreed placement; or
• Bullymon is otherwise unable to provide the specifically reserved puppy.

Where agreed, a deposit may instead be transferred to another available puppy, an upcoming Bullymon litter, or an approved Bullymon Stud Service.

A transfer does not automatically guarantee the availability of a particular puppy, breeding, pick position or stud service.

Any transfer arrangements will be confirmed directly with the buyer.

5. Puppy Pricing

Puppy pricing may vary according to the individual puppy, breeding, pedigree, development, placement and other relevant factors.

The applicable purchase price will be provided to the buyer before a reservation is confirmed.

Unless otherwise stated, the $1,000 AUD holding deposit is credited toward the total purchase price.

Breeding rights, where offered, may incur an additional fee and are available only to homes approved by Bullymon for breeding placement.

Any additional services or costs, including transport, flights, crates or other agreed expenses, will be advised separately where applicable.

6. Final Payment

The remaining purchase balance must be paid by the date agreed between the buyer and Bullymon.

Unless another date has been agreed in writing, a reserved puppy must be paid in full by its six-week birthday.

If the remaining balance is not received by the agreed due date, Bullymon may cancel the reservation and make the puppy available to another approved home.

Where a reservation is cancelled because the buyer fails to make payment by the agreed due date, the holding deposit may be forfeited and will generally not be refunded, subject to applicable law.

Full payment must be received and cleared before a puppy is released for collection or transport.

7. Payment Methods

Payments to Bullymon may be made by bank transfer, cash, or another payment method approved by Bullymon.

Banking or other payment instructions will be provided directly to the buyer.

Cash payments are accepted by prior arrangement only. A receipt or written confirmation will be provided for cash payments received.

Any applicable bank fees, transaction fees, payment processing charges, international transfer fees or currency conversion costs are the responsibility of the buyer unless otherwise agreed in writing.

A puppy, future puppy or pick position is not considered reserved until the required holding deposit has been received and confirmed by Bullymon.

For security, buyers should confirm any unexpected change to payment or banking instructions directly with Bullymon before transferring funds.

Bullymon will provide confirmation or a receipt once payment has been received.

8. Puppy Selection & Development

Bullymon takes considerable care when assessing puppies and providing information to prospective homes.

However, puppies continue to develop substantially as they mature.

Unless specifically guaranteed in writing, Bullymon cannot guarantee a puppy’s eventual adult height, weight, colour or colour development, body proportions, structure, temperament, show potential, breeding potential or other adult characteristics.

Photographs, videos, measurements and descriptions provided while a puppy is developing represent the puppy at that particular stage of development.

9. Veterinary Health Examination

Puppies will receive appropriate veterinary assessment before leaving Bullymon.

If a specifically reserved puppy does not pass its veterinary health examination or a significant health issue is identified that affects the agreed placement, Bullymon will discuss the situation with the buyer before the puppy is released.

Depending on the circumstances, the buyer may be offered an alternative puppy, transfer to a future breeding, or refund of payments relating to the affected puppy.

Any additional health guarantees or obligations applying after purchase will be detailed in the applicable Puppy Sale Agreement.

10. Collection & Transport

Bullymon will arrange an agreed date and time for collection once the puppy is ready to leave.

For interstate buyers, Bullymon can assist with arranging air or road transport and will provide the relevant collection or transport details.

Buyers may also arrange their own approved transport provider by prior agreement with Bullymon.

Unless specifically included in the agreed purchase price or otherwise agreed in writing, all transport, flight, crate and associated delivery costs are the responsibility of the buyer.

Full payment must be received and cleared before the puppy is released to the buyer or an authorised transport provider.

Once transport arrangements have been confirmed, any cancellation or rescheduling charges imposed by a third-party transport provider may be payable by the buyer.

11. Collection Date

Puppies must be collected or transported on the date agreed with Bullymon.

If the buyer is unable to collect the puppy on the agreed date, Bullymon must be notified as soon as reasonably possible.

Where Bullymon agrees to keep a puppy beyond the agreed collection date, additional boarding, care, veterinary or other reasonable costs may apply and will be discussed with the buyer.

12. Registration & Breeding Rights

Registration and pedigree documentation supplied with a puppy will depend on the individual puppy and the agreed placement.

Unless specifically agreed otherwise in writing, purchasing a puppy does not automatically include breeding rights.

Breeding rights are available only where specifically offered and approved by Bullymon and may be subject to an additional fee and separate conditions.

The applicable registration and breeding status will be confirmed with the buyer as part of the individual puppy’s sale documentation.

13. Information Provided by the Buyer

The buyer is responsible for providing accurate and complete information during the application and reservation process.

Bullymon may reconsider or cancel a placement if information relevant to the suitability of the home has been materially misrepresented or withheld, subject to applicable law and the circumstances of the reservation.

14. Puppy Sale Agreement

These Puppy Reservation Terms & Conditions govern the application, reservation, deposit and pre-collection process.

The final purchase and transfer of the puppy may also be subject to a separate Bullymon Puppy Sale Agreement, which may include additional terms relating to ownership, veterinary records, pedigree or registration, breeding rights, health provisions and buyer responsibilities.

Where applicable, the Puppy Sale Agreement will be provided to the buyer as part of the purchase process.

15. Acceptance of These Terms

By paying a holding deposit to Bullymon, the buyer confirms that they have:

• read and understood these Puppy Reservation Terms & Conditions;
• agreed to the applicable puppy or future reservation;
• understood the agreed purchase price and payment requirements;
• understood the applicable deposit, refund and transfer conditions; and
• agreed to proceed subject to these terms and any applicable Puppy Sale Agreement.

We encourage buyers to ask any questions about their reservation, payment obligations or these terms before paying a holding deposit.

Bullymon reserves the right to update these terms from time to time. The terms applying to an existing reservation will be those provided or made available to the buyer at the time the reservation was entered into, unless otherwise agreed or required by law.
